13:11 30 October, 2026The legal dispute between Halle Berry and her ex-husband Olivier Martinez is ongoing. A judge has denied the actor’s request for a restraining order against his former wife but upheld a decision granting Martinez primary physical custody of their 13-year-old son, Maceo. Berry has so far been unsuccessful in restoring the previous arrangement, under which the parents shared custody equally.
According to TMZ, the court declined to modify the existing custody arrangement. The matter is scheduled to be reviewed again in November, and until then, the couple’s son will continue to spend most of his time with Martinez.
The publication also reports that Berry will no longer be allowed to have overnight visits with her son. However, the court did not impose any restrictions on the time Maceo can spend with his mother during holidays. The actress retains joint legal custody, meaning she can still participate in important decisions concerning her son.
The latest escalation in the dispute stems from an incident on September 26. Martinez accused his former wife of grabbing their son by the neck and choking him during an argument. According to his account, the incident occurred while Maceo was playing a virtual reality game.
Berry denied the allegations. She said she and her son had simply been joking around and play-wrestling, insisting that she had never grabbed him by the throat.
During the court proceedings, Maceo also gave testimony in a closed hearing. Berry opposed this, expressing concern that her ex-husband may have influenced the teenager’s account. Martinez, meanwhile, maintained that he was acting in the interests of his son’s safety.
The court is due to revisit the custody arrangement in November. For now, Maceo will continue to live primarily with his father, while a final decision on the future custody arrangements has yet to be made.
