Halle Berry’s ex-husband, French actor Olivier Martinez, has secured temporary sole custody of their 12-year-old son, Maceo, after accusing the Hollywood star of physically abusing their child. Berry has categorically denied the allegations, calling them “absolutely baseless.”
According to court documents filed in Los Angeles on Thursday and obtained by the Daily Mail, Martinez alleges that Berry attacked their son on September 26, 2026, knocking him to the floor and choking him. The actor obtained a temporary restraining order protecting both himself and the child. Under the court order, Berry is prohibited from coming within 300 feet of her ex-husband.
The actress has also temporarily lost her equal share of joint custody of their son. Until a court hearing scheduled for October 16, she is permitted to see Maceo only on court-ordered days — twice a week and every other weekend.
Berry’s attorney, Marina Beck, told the Daily Mail that the allegations are “absolutely baseless,” adding that her client has become accustomed to what she described as similarly outrageous actions by Martinez.
According to Berry’s representative, the actress is deeply saddened by the situation but will not back down from fighting for her son’s well-being and will continue to provide him with the love and support he needs.
In court documents, Martinez described a series of conflicts involving the former couple and their son that he claims have taken place over the past several years. However, he said the incident in late September was what ultimately prompted him to seek court intervention.
Martinez alleges that over the past year and a half, Berry repeatedly wrestled with their son, knocking him to the floor and forcing him to submit by saying a designated safe word, “I give up.” He also claims that the actress grabbed the boy by the back of the neck several times when he was not expecting it and used choking techniques. According to Martinez, Berry presented such behavior as a joke or a game, although the child did not like it.
According to Martinez’s account, the September 26 confrontation began when Berry criticized her son while he was playing a virtual-reality game using special goggles. The actress allegedly called him “stupid” and an “idiot.”
The actor claims that Berry entered Maceo’s bedroom and began pushing him. Initially, according to Martinez, the incident may have appeared to be playful. But when the boy asked his mother to stop and let him finish his game, the situation allegedly escalated sharply.
“She went after Maceo, started fighting with him, grabbed him by the neck and choked him, yelling, ‘Who’s in charge now? Who’s in charge now?’” the court documents state, citing Martinez’s account.
The actor alleges that his son had to fight back to free himself from the hold. Eventually, the boy managed to break free and began screaming. According to Martinez, Berry’s fiancé, musician Van Hunt, entered the room after hearing the screams.
According to the documents, Maceo had spoken positively about Hunt and considered him fair toward him. Martinez also said Berry’s fiancé stood up for the boy when he was packing his belongings to leave the house. Berry allegedly did not want her son to take his clothes because she had purchased them, but Hunt supported the child and persuaded the actress to let him take his belongings.
That evening, Martinez said he received a desperate phone call from his son asking him to come and pick him up immediately. The actor contacted Berry by text to ask whether she agreed to let him come for Maceo.
The court documents include messages in which Berry allegedly responded: “No, I do not agree. Does he want to fight his mother? What kind of child are we raising?”
Martinez claims he spoke with his son several more times by phone and heard Berry’s voice during one of the calls. According to him, the boy told his mother he was going to leave for good, to which she allegedly shouted: “Fine. Fine. I don’t want to see you anymore.”
The father also said he received several persistent messages from Maceo asking when he would arrive.
When Martinez arrived at his ex-wife’s home, his son came outside with Hunt, who was carrying the boy’s bags of clothes. According to the actor, Berry’s fiancé appeared shaken but did not answer his questions about what had happened.
Martinez claims he initially did not know about the alleged physical altercation between Berry and their son and chose not to question the boy during the drive home. Only later that evening, he says, did Maceo tell him what had happened.
The following morning, Berry allegedly sent Martinez a message saying that she had spoken with their son and wanted to talk to him. The actress also allegedly wrote that she felt terrible about what had happened the previous day and understood that Maceo was struggling with it as well.
Martinez said that following the incident, his son no longer wanted to stay at his mother’s home and may have suffered psychological trauma.
In his filing, Martinez also alleged that the incident in September was far from the first. He claims that both Berry and Maceo had previously told him about incidents in which the actress allegedly used choking techniques on the child that she had learned while training in mixed martial arts.
Martinez claims the boy repeatedly expressed his displeasure with his mother’s behavior, but that she downplayed the seriousness of what was happening, describing it as a joke or a game. According to the actor, his son eventually threatened to fight back if it happened again.
The court documents also accuse Berry of verbal and emotional abuse, including toward Martinez himself. He alleged that the actress made racist remarks about his father to their son and threatened to have him deported to France.
In his filing, Martinez asked the court to order Berry to complete a 52-week anger-management program, refrain from consuming alcohol or other intoxicating substances during visits with their son, and undergo regular sobriety testing before, during and after spending time with the child. The actor is also seeking to maintain the restraining order protecting himself and his son.
The court has ordered the former spouses to participate in confidential mediation to discuss custody issues.
Halle Berry and Olivier Martinez married in 2013, and their son, Maceo Robert, was born that same year. The couple separated in 2016, and their divorce was finalized in 2023. Following their court proceedings, the former spouses were granted joint custody, while Berry was ordered to pay child support.
In 2024, the actress returned to court, this time asking the judge to order Martinez to participate in joint co-parenting therapy. Berry alleged that her ex-husband was attempting to avoid the sessions. The court ultimately granted her request, noting that Martinez had already complied with the requirement by that point.
In August 2024, however, a court rejected Berry’s request to require her former husband to attend joint therapy. That same year, the actress also sought sole custody of their son, but that request was denied as well.
During the earlier legal proceedings, Berry said she had spent more than $200,000 on legal fees, including voluntarily providing $80,000 to cover Martinez’s legal expenses. She also claimed that her former husband was effectively supporting himself with the child support payments she made.
The actress had sought sole custody, arguing that Maceo was struggling at school and was several grade levels behind his peers. According to Berry, her son had been diagnosed with attention-deficit/hyperactivity disorder (ADHD) and a mild form of dyslexia. She accused Martinez of either failing to recognize their son’s difficulties or treating them dismissively.
